The General Regulation on Personal Data Protection introduces the figure of the so-called data protection officer. This is an employee of a personal data controller or a natural person external to the controller’s organization, charged with advisory functions in the field of personal data protection, supervision of compliance with the Regulation in the controller’s organization and raising awareness and training of staff. For the first time, the appointment of such an official derives from an act by operation of law and becomes mandatory in cases expressly provided for in the Regulation.
According to the Regulation only certain categories of controllers must have a data protection officer, namely:
• Public bodies or structures – state and municipal bodies, others;
• Public structures (e.g. bodies controlling the activity of regulated professions; public transport; etc.) – the subjects have limited or no choice as to whether and how their data should be processed and need additional protection;
• Administrators whose activities, due to their nature, scope and objectives, require regular and systematic large-scale monitoring of data subjects such as medical institutions, security companies, banks, insurance companies;
• Administrators, whose main activities consist of large-scale processing of special categories of data and personal data related to convictions and violations;
The Regulation requires the data protection officer to have in-depth expertise in the field of personal data protection legislation and practice.
